This title is obtained by choosing to spare captain Orzik the during Black talon flashpoint. You will only receive this title if the players whose chat roll wins chooses the light side option, if the dark side option wins out you will not receive this title. In reverse, if you are trying for the merciless title and the light side option wins out, even though you chose the dark side option, you will not be able to obtain merciless this run and will instead get this title. So talk to your group mates and make sure everyone is happy with these two major story hinge points.

Or run it multiple times and get both titles.

You actually get this title if a Light Side choice wins the conversation roll, regardless of the option you pick yourself.

Yes I have both though I always chose darkside, to kill Captain Orzik.

This title can ONLY be obtained by saving the captain and is awarded after you get back to your base and choose to go back to the Imperial Fleet or Dromund Kass. You can choose the dark option and kill him, however, if your group goes for the light option and saves him it will still give you the dark side points. This flashpoint is soloable at level 10 - I did it with a Bounty Hunter with Mako as my companion.

This is obtained by selecting the Light Side option during the Black Talon flashpoint and sparing Captain Orzik.
