On Empire side, you need to complete http://www.torhead.com/mission/dOvHlXU/immediate-vengeance (Immediate Vengeance) in order to be eligible to enter this flashpoint on normal mode or hard mode. If you, or somebody in your group, isn't eligible for this flashpoint, that's why.
Sidenote: If you're planning on doing it hard mode, be sure to abandon the quest it gives you when you complete Immediate Vengeance, since it's the normal mode quest for D7. Then you talk to the little droid outside and pick up the hard mode version.
